Welcome to BuzCall. Please read these Terms of Service ("Terms") carefully as they contain important information about your legal rights, remedies, and obligations. By accessing or using the BuzCall website or services, you agree to comply with and be bound by these Terms.

1. Acceptance of Terms

By accessing or using our website and services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

2. Description of Service

BuzCall provides an AI-powered answering service for businesses ("Service"). Our Service allows businesses to create and deploy AI agents that can answer phone calls, provide information to callers, and perform other automated communication tasks. The specific features and functionality of the Service may change from time to time.

3. Account Registration

To use our Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription and Payments

Our Service is offered on a subscription basis. You agree to pay all fees associated with your selected subscription plan. All payments are non-refundable except as expressly set forth in these Terms.

  • Subscription fees are billed in advance on a monthly basis.
  • You authorize us to charge your designated payment method for all fees incurred.
  • If your payment cannot be completed, we may suspend or terminate your access to the Service.
  • We reserve the right to change our pricing terms at any time, and such changes will apply to subsequent billing cycles.

5. User Content and Conduct

You are solely responsible for all content that you provide to train your AI agents ("User Content"). You represent and warrant that:

  • You own or have the necessary rights to use and authorize us to use all User Content.
  • Your User Content does not violate any third party's intellectual property rights, privacy rights, or other rights.
  • Your User Content and use of the Service complies with all applicable laws and regulations.

You agree not to use the Service to:

  • Violate any laws or regulations.
  • Infringe upon the rights of others.
  • Distribute harmful, offensive, or inappropriate content.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Attempt to gain unauthorized access to any portion of the Service.

6. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by BuzCall and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not copy, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material obtained through the Service without our prior written consent.

7. Limitation of Liability

To the maximum extent permitted by law, in no event shall BuzCall, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Indemnification

You agree to defend, indemnify, and hold harmless BuzCall and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Service, your violation of these Terms, or your violation of any rights of a third party.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Philippines, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
